Supreme Court came down hard on the Nitish Kumar government in over its failure to file correct first information report in Muzaffarpur shelter home abuse case and gives 24 hours to it add charges under Section 377 (sodomy) of Indian Penal Code and Prevention of Children for Sexual Offences Act in the FIR.

“If we find that there were offences under Section 377 of the IPC and POCSO Act and you did not register FIR, we will pass an order against the government,” the SC said.

Slamming the Bihar government, the SC said, “What are you doing? It’s shameful. If the child is sodomised you say it’s nothing? How can you do this? It’s inhuman. We were told that the matter will be looked with great seriousness, this is seriousness? Every time I read this file it’s tragic.”

The SC asked counsel appearing for the Central Bureau of Investigation to take instruction if the agency can investigate the cases relating to sexual assault in nine out of 17 shelter homes in Bihar named in the Tata Institute of Social Sciences report
